As per Senate Bill SB 4-D signed in May 2022, for condominiums and cooperative associations with 25 to 30 years of age, having 3 stories or more, a structural integrity assessment is mandated, known as a milestone inspection.
Who is accountable for ensuring compliance?

In the event of an inspection, any management companies or community association managers that have been contracted by a condominium association are required to adhere to the regulations as instructed by the board.

Is it mandatory to conduct milestone inspections for every building in Florida that has a height of three (3) stories or more?
It is mandatory to conduct building inspections once a building reaches the age of 30 years, taking into account the date of its certificate of occupancy issuance. These inspections must be completed by December 31st of that year and every ten years thereafter. However, for those structures which are within 3 miles of the coastline, they need to get a milestone inspection by 31st December of the year in which they reach 25 years in age and after that, every 10 years.
At what point in time did the State mandate the initiation of milestone inspections?
For buildings that have a certificate of occupancy issued on or before July 1, 1992, it is mandatory to conduct the initial milestone inspection by December 31, 2024. However, for all other buildings, the year for conducting the inspection is determined based on the date of issuance of the building's certificate of occupancy.

How many phases are there for a milestone inspection in Florida?

Florida milestone inspection consists of 2 phases: PHASE 1 and PHASE 2.

PHASE 1:

It is a form of visual inspection that is done in order to understand the basic structural integrity. A certified inspector will analyze the entire building structure to figure out if there are any issues. The reason behind the inspection and report is to confirm that the structure under consideration is secure for continued use under present occupancy. Now, should “substantial structural deterioration” be found during this inspection, the second phase of the inspection will need to be conducted, i.e., PHASE 2.

PHASE 2:

The inspection process may encompass both destructive and non-destructive testing, as deemed appropriate by the inspector. This supplementary examination will be conducted with utmost thoroughness or restraint, depending on the extent of the damage to be evaluated. What happens once the milestone inspection report is finished?
The individual responsible for conducting inspections, whether an architect or engineer, is required to provide a sealed copy of the inspection report and its findings to both the association and the relevant officials. Will the association get any notification about when a milestone inspection in Florida should take place?

Condo or cooperative association will receive a notice of required inspection from the county officials for necessary steps via mail. Even if not received, it’s the association’s responsibility to get the inspections done in a timely manner to avoid any penalty or punishment.

Once receiving the inspection notice, what is the deadline to get it done to comply with the regulations?
From the moment you’ve received the notice, you have a total of 180 days to get phase one of the inspection complete, whether you’re living in a condominium or a cooperative association.
In case the inspection and necessary repairs weren’t carried out, who will be the one responsible for it?
It would be on the associations’ end. If they fail to have the required milestone inspection done, they will be breaching the directors’ and officers’ fiduciary relationship with the unit owners. This could invite severe penalties. Milestone inspections in Florida are taken very strictly and should be the same in the minds of the association owners too.
